Three days ago passed the fourth anniversary (publication from 2020) of the death of Marian Zagórny (1960-2016). A resident of Rybnica, since childhood associated with agriculture, problems of the countryside and farmers, since 1980 a trade union activist. He remained in the memory of Polish farmers as a leader, a warrior, an uncompromising rebel, always distrustful of the authorities, allergic to political trickery and empty talk. Rebellious, peasantly, stubbornly, always with a pure intention, he fought for just causes serving the common good. The chairman of the Trade Union of Farmers of the Republic of Poland „Solidarni”, who earlier, in the years 1997 – 2003, headed the National Protest Committee of NSZZ RI „S”, conducted many radical, spectacular protest actions. They served to draw attention to the basic problems of agriculture, however, they were also perceived as political adventurism. Marian Zagórny did not throw accusations blindly, as he himself assured, he always had well-documented evidence.

Nearly a thousand people from all over Poland said goodbye to the well-known activist at the cemetery in Rybnica, including politicians, a delegation from the Chancellery of the President of the Republic of Poland and colleagues from various periods of Marian’s trade union activity.

Rebellious with 17 convictions

„He’s a man of legend.” He used to fight for something, he was able to make a real sacrifice. This commands respect. Few of us can afford such courage to sacrifice our good name for the sake of a good cause. They said about him that he was difficult. But it’s better to be difficult in a just cause than to agree to everything, to give in, giving up your ideals, said Marzena Machałek, MP of Marian Zagórny.

Seventeen final convictions, numerous fines, three months in prison, harassment by Security Service officers, multiple detentions for 48 hours, searches, severe beatings twice by „unknown perpetrators”, health problems, neglected family life are the personal costs of Marian Zagórny’s activity.

– Marian fought for everything and everyone. For protest actions, he was tried and convicted for causing seven million damages. We defended him then, we vouched for him, we got him out of trouble as much as we could. At that time, many incomprehensible things were happening in Poland – stresses Ryszard Matusiak, a former MP and former chairman of Solidarity in Jelenia Góra.

When is the presidential pardon?

Many people and organizations were involved in defending the agricultural union activist. Marian Zagórny, who was waiting for a pardon, believed that the change in the position of the President of the Republic of Poland would help him. He lived to see the change, no pardon. He appealed to President Andrzej Duda for clemency many times. Marian Zagórny also pointed to the need to establish the Material Reserves Agency, which was supposed to secure food reserves in the event of disasters and stabilize farmers’ incomes. He also sent letters to the then Deputy Prime Minister Mateusz Morawiecki on this matter.

Marcin Bustowski from Jelenia Góra, Marian Zagórny’s closest collaborator in the Trade Union of Farmers of the Republic of Poland „Solidarni”, and after his death, the chairman of this organization in the „Nowina” conversation (August 2018), „We will all feel the effects of drought” said: „If we lived in a normal country stocks would be a security for such situations. We don’t have any stocks – I’ve known that for a long time. Marian Zagórny knew about it (and in my opinion, he died because of making this knowledge public), and recently it was confirmed by the report of the Supreme Audit Office.

– When Marian was still alive, the Jelenia Góra Region Board of NSZZ „Solidarity” applied to the President of the Republic of Poland to remit Marian’s sentence. I have not had contact with his family recently. I was convinced that President Andrzej Duda had forgiven Marian’s sentences and pardoned him. I am surprised to hear that these cases still involve the deceased activist. We certainly owe him something, says Franciszek Kopeć, chairman of the Trade Union of NSZZ „Solidarity” in Jelenia Góra.

The deputy, deputy minister of education, Marzena Machałek, could not determine at what stage the issue of pardoning Marian Zagórny was.

This needs to be checked and clarified.

– I do not have access to documents. The head of Solidarity in Jelenia Góra, Mr. Kopeć, has the same opportunity as me to write an application to the office of the President of the Republic of Poland. We remember Marian Zagórny and his union activity.

Marian’s son, Kamil Zagórny, says that the president sent a letter from which it follows that the father cannot be pardoned posthumously.

– Marian was a wonderful man who did not agree to the existing reality, he was able to diagnose it and indicate directions of change. He helped me with The Story of Roja, a film about a cursed soldier who loved freedom and justice. Marian collected money, organized demonstrations of the working copy. He left two days before the premiere, says director and journalist Jerzy Zalewski. During the premiere of „Roja’s Story” in 2016, President Andrzej Duda assured that he would be interested in the investigation into the circumstances of Marian Zagórny’s death.

No toxicological studies

A trade union activist of „Solidarity” came to Warsaw for further business talks on agriculture and for the premiere of the film. He was found dead in a hotel in Raszyn. Despite the two-time investigation by the District Prosecutor’s Office in Pruszków and the final legally binding discontinuation of the investigation, the case of death must be described as unexplained. “As a mother, I have a right to know what happened on that fateful day. Marian Zagórny is not only my son, but also a man who helped many people. The son’s death seems mysterious. There are discrepancies in the testimonies of witnesses. Toxicology results are not available. It was not explained where the burn marks on Marian’s body came from. Please send me an autopsy report,” Stefania Zagórna, the mother of the deceased, wrote to the prosecutor’s office in a complaint against the decision to discontinue the investigation of July 13, 2016. In response, prosecutor Izabela Jagnieża informed: „No toxicological tests were ordered in the case, because the content of the forensic and medical report of the examination of the corpse did not indicate such a necessity.” The decision to discontinue the investigation reads: „No circumstances have been disclosed indicating that Marian Zagórny’s death occurred as a result of a criminal act or omission of third parties.”

The place of death was the bathroom. Around 1:15 am, Marcin Bustowski, who was accompanying Zagórny, found the body completely under the surface of hot water. He flushed the water and called for help. A rescuer from the Provincial Ambulance and Sanitary Transport Station noted: „After the initial examination, I was unable to determine the cause of death, as well as whether other people could have contributed to the man’s death. The body of the deceased showed first-degree burns to almost the entire body except for the neck and head. A police patrol was called to the scene. Attention was drawn to the strangely twisted hands of the deceased visible in the photos. Was this position of the upper limbs and hands created before or after death, and could it have been the result of the actions of third parties?

Death still unexplained

The court upheld the appeal of the Zagórny family. After resuming the proceedings, prosecutor Izabela Jagnieża appointed an expert. Mieszko Olczak, MD, PhD, diagnosed acute pulmonary distension (water emphysema) and no evidence that death was caused by mechanical causes. The cause of Marian Zagórny’s death was drowning. Strangely enough, the hotel’s video surveillance was not working that day. The room was open but no one saw anyone entering the hotel.

In the article „The involvement of third parties cannot be ruled out in the death of Marian Zagórny” published in 2018 in Farmer, Marzena Pokora-Kalinowska enumerates six questions formulated by the court. The expert’s answer shows that Zagórny did not have to drown in the bathtub at all – he left it after the bath. While taking a bath, he talked with a friend for 28 minutes. He didn’t hang up the call. She heard the sounds of him getting out of the tub, the clatter of the crutches on which he moved, the clatter of pottery, the sound of something being put down, being wiped off… The connection was suddenly cut off. The witness did not hear the phone off button.

It leaves little inquisitiveness of the prosecutor’s office. Are you sure that all the circumstances that should have been disclosed have been disclosed? Has the course of events of the critical night been established at all? The body was cremated.

„My brother’s case is still unsolved. I dream of the moment when I will know the truth about his death,” Mariana Zagórny’s sister, Janina Urbaniak from Rybnica, wrote in a letter to the District Prosecutor’s Office in Warsaw.
